Warranty Policy
Repair Services Limited Warranty
1. Limited Warranty. The limited warranty covers only those products that are owned by the individual requesting repair services (“Purchaser”) and sent to SRC Electronics, Inc. (“Clear-Cast”) for the purpose of Clear-Cast performing repair services (the “Product”). Clear-Cast warrants that any Product repaired by Clear-Cast will be free from defects in workmanship under normal use and service for ninety (90) days from the date the repaired Product is shipped by Clear-Cast to Purchaser.
2. Remedies. Clear-Cast’s obligation to Purchaser with respect to any Product for breach of Clear-Cast’s Limited Warranty is limited, at Clear-Cast’s option, to attempting to repair the Product a second time, replacement of the Product with a similar product, or refunding the fees Purchaser paid to Clear-Cast for services related to the Product, less any shipping expenses incurred by Clear-Cast related to the Product. Clear-Cast shall not be liable for the loss of use of any Product, loss of time, inconvenience, commercial loss or any other direct, indirect consequential, special or incidental damages due to breach of the above warranty or any other failure to comply with the terms of the contract between Clear-Cast and the Purchaser.
3. Disclaimer. CLEAR-CAST’S LIMITED WARRANTY FOR THE PRODUCT IS EXPRESSLY IN LIEU OF ALL OTHER WARRANTIES, EXPRESS OR IMPLIED, INCLUDING ANY WARRANTY OF MERCHANTABILITY OR FITNESS FOR A PARTICULAR PURPOSE.
4. Exclusions. Clear-Cast’s Limited Warranty is subject to, and qualified by, the warranty administration provisions set forth herein and by the following exclusions:
a. With respect to parts and materials manufactured by others and incorporated by Clear-Cast into the Product, such parts and materials shall be covered only by the warranty, if any, of the manufacturer thereof, and Clear-Cast shall assign to Purchaser any such warranty to the extent assignable by Clear-Cast, and upon Purchaser’s request, shall cooperate with Purchaser, at Purchaser’s expense, to seek to enforce such warranties on Purchaser’s behalf. Clear-Cast shall not provide any other relief and provides no warranty with respect to such parts and materials.
b. The following are not covered by Clear-Cast’s Limited Warranty:
i. Failure of the Product caused by
1) incorrect installation or adjustment following shipment by Clear-Cast;
2) improper use, abuse, or negligence following shipment by Clear-Cast;
3) improper storage or handling of Product subsequent to shipment by Clear-Cast and prior to installation;
4) accident or act of God;
5) normal wear and tear;
6) the use of unauthorized accessories or parts;
7) improper or unauthorized repairs or services;
8) a pre-existing condition of the equipment into which Product is installed; or
9) unauthorized modification of Product (or the equipment into which Product is installed) that alters its form, fit, or function.
ii. Progressive damages.
c. Clear-Cast’s Limited Warranty shall be void and of no force and effect if repairs made by Purchaser to Product are (1) not made in conformity with the applicable original manufacturer specifications or (2) are made without the express written approval of Clear-Cast.
d. The following are not covered by Clear-Cast’s Limited Warranty: (a) costs incurred Purchaser for the removal and/or reinstallation of the Product, (b) injury to any person or property or death of any person, (c) payment to any third-party for services not agreed to in writing by Clear-Cast prior to the engagement or use of such services and (d) travel time, mileage, meals, tolls, lodging and other travel expenses.
Warranty Administration
The following warranty administration provisions shall apply to any alleged breach of Clear-Cast’s Limited Warranty made by Purchaser to Clear-Cast related to Clear-Cast’s repair of Purchaser’s Product:
1. Claim Information. For a warranty claim to be valid, the Purchaser must complete the Repair Form located on Clear-Cast’s website (clearcastmarine.com) and indicate on the Repair Form that it is a Warranty Claim by checking the Warranty Claim box. A copy of the completed Repair Form and the Product must be sent to 2401 East Sunshine Street, Springfield, Missouri 65804 within ninety (90) days of the date Clear-Cast initially shipped the repaired Product to Purchaser.
2. Clear-Cast’s Limited Warranty Claim Processing. Clear-Cast’s Limited Warranty claims shall be processed by Clear-Cast within five (5) to seven (7) business days of receipt, provided that the completed Repair Form and the failed or defective has been provided to Clear-Cast. Within such time period Clear-Cast shall inform Purchaser whether Purchaser’s warranty claim is valid or denied.
3. Shipping/Handling. Purchaser shall be responsible for the cost to return the failed Product to Clear-Cast. If Clear-Cast approves the warranty claim, then Clear-Cast will be responsible for the cost to ship the repaired Product back to Purchaser or ship the replacement Product back to the Purchaser (at Clear-Cast’s option). If Clear-Cast rejects the warranty claim, then Purchaser shall be responsible for the cost to return the Product to Customer.
4. Disposition of Returned Product. For all warranty claims, if Clear-Cast successfully repairs the Product, Clear-Cast will return the original Product. If Clear-Cast chooses to provide a replacement product or to refund Purchaser for the cost of services, less the shipping expenses, the returned Product becomes the property of Clear-Cast.
Used Parts & Accessories
All used products, parts, and accessories sold by Clear-Cast are sold “AS IS.” Clear-Cast specifically disclaims all warranties on such used products, parts and accessories.
